Local 99 Members at Lynwood Win New Contract

With more than half of our entire bargaining unit voting at the SEIU Local 99 Lynwood office on February 26, results showed significant membership support — the vote was over 4-to-1 in support of our new SEIU Local 99 contract with the District.

Then on Tuesday, March 12 — again with a show of SEIU Local 99 support at the School Board Meeting — Lynwood Unified School Board Members also ratified the contract. View photos of our Board Action here.

Highlights of our agreement include:

  • $1000 bonus paid on a prorated basis (see table below).
  • The District will increase its contribution to our healthcare benefits to $8000 per year. This means less out-of-pocket costs for us.
  • Three furlough days each year for 2012-13 and 2013-14. This guarantees no layoffs. And we have the right to  re-open negotiations over these furloughs if the District receives additional funds in the state budget.
  • A job classification study so our pay reflects the actual work we do.

SUMMARY OF THE AGREEMENT BETWEEN SEIU 99 and LYNWOOD USD:

This is a summary of the Agreement our SEIU 99 Bargaining Team reached with District management on February 19, 2013. It includes the same economic package recently negotiated by CSEA (see “ECONOMIC PACKAGE” summary below). It also includes clarification on items like performance evaluations and scheduling work hours/breaks. It has economic reopeners during the term of the new contract, and the District agreed to negotiate a Comprehensive Classification Study.

A. ECONOMIC PACKAGE:

1. $1,000 Bonus. One-time; off schedule; payable upon ratification of entire agreement, as follows:

2. Increase from $7400 to $8000 Annual District Health Premium Contribution. Per FTE; effective 2013-14 school year.

3. Three furlough days each year for 2012-13 and 2013-14. No loss in vacation, holiday pay, sick leave, or other benefits had the furloughs not occurred; no layoffs or other cuts for 2012-13; scheduled between employees and their immediate supervisors for 2012-13, and, Thanksgiving week 2013 (November 25, 26 & 27) for 2013-14; deducted from paycheck on the 10th of these months: April, May, June 2013 and February, March, April 2014; anyone who requests service retirement before March 15, 2013 will not have to take any furloughs.

B. OTHER ITEMS:

1. Clarifies existing contract language consistent with state law and personnel rules.

a. Recognition (consistent with PERB rules and procedures);

b. Evaluation (consistent with PC Rule 60.500);

c. Lunch Periods and Breaks (consistent with applicable law);

d. Establishing 4/10 schedules (consistent with Ed Code Sec. 45132);

e. Discipline (consistent with applicable PC Rules)

2. Sets Performance-Based (Merit) Step Increases for New Hires. Employees hired after ratification may have step increases and bonuses delayed until correcting “inadequate” performance.

3. Contract Re-Negotiations (“Reopeners”).

a. 2012-13: Comprehensive Classification Study, District Rights, Discipline;

b. 2013-14: Compensation and two additional articles (by each party).

4. Duration: July 1, 2012 through June 30, 2015.
