Tentative Contract Agreement Reached with Santa Monica Malibu Unified

On December 8, 2017, our SEIU Local 99 Team reached a Tentative Agreement with Santa Monica Malibu Unified School District for a 2016-2018 full contract. This Tentative Agreement is subject to ratification by Local 99 members at SMMUSD. Members received a ballot in the mail to vote on the agreement. Mailed ballots must be received no later than 5:00 pm Monday, February 5, 2018. Members may choose to vote in person on Tuesday, February 6, 2018 at the District Office (8:00 am – 4:00 pm); SAMOHI (8:30 am – 3:30pm); Malibu HS (10am – 2pm); Webster ES (2:30pm – 3:00 pm); Transportation (10am-11am); Grant ES (9am-3pm); Franklin ES (9:00 am – 3:00 pm). Ballots will be counted at the District office on February 6, 2018 at 4:01 pm. All members are welcome to observe the counting. You must be a member to vote. Non-members may complete a member card to receive a ballot to vote.

SUMMARY OF TENTATIVE AGREEMENT: SEIU LOCAL 99 AND SMMUSD

ARTICLE 1 – AGREEMENT, DESIGNATION OF PARTIES, AND LENGTH OF CONTRACT

Term of Agreement is July 1, 2016 through June 30, 2018.

ARTICLE 2 – RECOGNITION

Update lists of represented and unrepresented classifications.

ARTICLE 3 – WORKLOAD

District agrees to expeditiously fill vacant, budgeted classified positions; District agrees to meet with the Union to address positions remaining vacant for more than 30 days.

ARTICLE 4 – HOURS OF EMPLOYMENT

Include language previously negotiated for breaks/lunch periods in Transportation.

ARTICLE 5 – EVALUATION PROCEDURES

Changes annual performance evaluations to every other year, during the period between January 1 and 10 working days before the end of the unit member’s work year.

ARTICLE 6 – REMEDIATION PROCEDURES

Clarifies definition of just cause and due process to include an objective investigation; clarifies purpose and steps of positive progressive discipline.

ARTICLE 8 – TRANSFERS

Establishes transfer procedures for Special Education.

AREICLE 11 – VACATION

Remove reference to “department.”

ARTICLE 14 – NON-DISCRIMINATION

Update list of protected classes.

ARTICLE 16 – WAGES

$1,550 one-time, off schedule payment, prorated per FTE, to all permanent unit members employed between July 1, 2016 and December 22, 2017; “me-too” on wages with SMMCTA if more than the off-schedule payment or any on-schedule increase during the term of the Agreement; SEIU agrees to participate in discussion with District on its budget reduction plan.

ARTICLE 17 – HEALTH AND WELFARE BENEFITS

SEIU agrees to participate on a joint health and welfare benefits committee with the District and SMMCTA.

ARTICLE 19 – SPECIAL PROVISIONS

Clarifies process for making overtime assignments in Transportation.

ARTICLE 29 – WORKING OUT OF CLASS

Clarifies process for making out-of-class assignments.

ARTICLE 30 – LAYOFFS/REDUCTION IN HOURS

Updates layoff notice to comply with state law.
