Members Ratify Contract Agreement at Santa Monica Malibu Unified

SMMUSD and SEIU Local 99 Summary of Contract Agreement

1. Salary: 4% Wage Increase, on schedule, retroactive to July 1, 2013 (applies to all unit members who are in paid status as of May 1, 2014).

2. Health Insurance: Maintenance of current health insurance benefits for all current employees; for full-time employees (0.875 – 1.00 FTE) hired after July 1, 2014, District contribution is reduced to 95% of lowest HMO premium; current District contribution for employees less than 0.875 FTE hired after July 1, 2014 remains the same.

3. Salary Survey: District agrees to meet regularly during 2014-2015 in order to analyze, assess, discuss possible implementation and/or update the survey; contract may be opened by mutual agreement to implement salary survey during 2014-2015.

4. Contract Duration: Previous contract extended from July 1, 2011 through June 30, 2013; term of new contract is July 1, 2013 through June 30, 2016.

5. Reopeners: Negotiations to begin no later than May 1, 2015 to bargain on Wages (Article 16), Health and Welfare Benefits (Article 17) and two other issues per side.

6. Personal Necessity Leave: Employees continue to be able to use their annual sick leave accrual for personal necessity; personal necessity leave shall not be used as vacation or to extend vacation; clarify that misuse of personal necessity leave is subject to remediation procedures as provided by Article 6.

7. Admission Day: District will make sure that future rescheduling of Admission Day Holiday will result in an extended weekend (at least a three-day weekend); for 2014, the observance of Admission Day is moved to the day after Thanksgiving (November 28).

8. Hours of Employment: Adds language to require distribution of additional assignments the same as overtime (rotated by seniority); clarifies compensation for assignment of additional hours of work; unit members accepting additional assignments, other than their regular assignment, shall be supervised by the administrator of the additional assignment.

9. Safety: New language requires District to provide safety equipment; requires District and unit members to adhere to the Injury and Illness Prevention Plan (IIPP); clarifies that Campus Security Officers, Bus Drivers and Vehicle & Equipment Mechanics are required to wear uniforms for safety purposes.

10. Catastrophic Leave: Clarifies cap at 2,400 hours or 300 days; allows for additional contributions when catastrophic leave bank balance drops below 480 hours (60 days).

11. Professional Growth: Effective July 1, 2014, professional growth increments may be awarded every two years, except for employees who are already in process to get their next professional growth increment (current timelines apply).

12. Grievance Procedure: Clarifies that alleged violations of Merit Rules are processed through Merit Rule grievance process; standardizes time limits to 10 business days; adds mediation step prior to arbitration.

13. Uniforms: Clarifies that unit members required to wear a uniform shall be reimbursed for the cost and replacement of the uniform only (not for the cost of maintenance of such uniforms, except by current District practice).
