We did it! Union members stood strong and filed a class action grievance that resulted in a victory that will impact summer school assignments.

Our Unit B contract clearly states that the District must notify members in writing of their summer session assignments for the Extended School Year (ESY) (Article XI, Section 7.2b). So, last year, when the District began to make special education assignments verbally or simply failed to notify members about the status of their assignment application, we filed a class action grievance to defend our contract. Thanks to members who spoke out, we’ve won a settlement that will ensure the District follows a clear process on ESY assignments and members receive timely and written notification of their assignments.

Under our grievance settlement agreement, LAUSD’s Division of Special Education and the Office of Personnel Commission agreed to provide a timeline every year for ESY assignments. Here’s the schedule for 2014 and highlights of our grievance win:

The Summer School Application period begins Monday, March 10, 2014 and ends Friday, March 28, 2014 (5 p.m.).

Assignments will be determined beginning May 2.

Applicants will be notified starting May 23 until the staffing assignments are completed.

The Office of the Personnel Commission will notify members by sending an email to their lausd.net email address and a letter to their home address. Be sure the District has your current home address.

Starting this year, The Office of Personnel Commission will staff an assignment hotline the week before and during the first two weeks of ESY. The hotline number will be listed in the assignment notices.

Every year, the updated ESY notice will allow assignments to be declined. No action will be necessary to accept an offer.

Additionally, as part of our settlement, the District will not reassign special education staff during the ESY placement period (April – May). This will ensure that the District has accurate information when making assignments and will give members the opportunity to work ESY at the school where they’ve served most of the school year.

If you need additional information about the ESY application process or this settlement agreement, please contact SEIU Local 99’s Member Resource Center at 213-637-0296.
